Welcome to Swift. By using the Swift application or any of its services, you agree to comply with these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, please do not use the application or services.


1. Definitions

1.1 Swift Application

Swift is a multi-vendor delivery platform that provides e-commerce, food ordering, delivery, and financial solutions within the Republic of Iraq. The platform is owned and operated by Verliban.

1.2 Application and User

  • Application: The Swift mobile and web application.
  • User: Any person who creates an account or uses the application’s services.

1.3 Merchant and Courier

  • Merchant: Any restaurant, market, or store that offers products or services through Swift.
  • Courier: An independent contractor responsible for delivering orders to users.

1.4 Order

Any purchase or service request made and processed through the Swift application.


2. Scope of Service

2.1 Platform Role

Swift is a technical intermediary platform connecting users, merchants, and delivery couriers. The platform does not own, manufacture, sell, or directly control any products, nor does it directly control the quality, preparation, or availability of products offered by merchants.


3. Account Creation

3.1 Eligibility and Security

To use Swift, you must be 18 years of age or older. Users are required to provide accurate, complete, and up-to-date information during registration and maintain the confidentiality of their login credentials. Users are solely responsible for all activities conducted through their accounts.


4. Orders & Payment

4.1 Product Pricing

All prices displayed within the application are shown in the local currency and determined by the merchants. Prices may include applicable taxes and fees. Once an order is confirmed, it cannot be modified or canceled except in accordance with the merchant’s approved policies.

4.2 Currency Processing & Exchange Rates

All financial transactions within the application are processed and settled exclusively in Iraqi Dinar (IQD) to protect transactions from exchange rate fluctuations. Swift is not responsible for any currency conversion differences or fees resulting from the use of foreign currency cards.

4.3 Refund Policy & Wallet Balance

If a prepaid online order is canceled by the merchant, the full order amount will be returned as a “Refund Balance” to the user’s in-app wallet within (3) to (7) business days. The platform is not responsible for any additional delays caused by partner payment gateways or banking institutions.


5. Delivery & Courier Responsibility

5.1 Independent Delivery & Force Majeure

Deliveries are performed by independent couriers. Estimated delivery times may be affected by weather conditions, traffic congestion, security circumstances, or other events beyond the platform’s control. Swift is not liable for delays resulting from such circumstances.

5.2 Damaged or Lost Shipments

If a courier mishandles, damages, loses, or tampers with an order, the platform shall not bear direct civil liability. However, Swift commits to providing technical and customer support assistance to help mediate disputes and provide users with the necessary information to pursue compensation from the responsible party.


6. Refunds & Complaints

6.1 Official Complaint Period

Refund and return policies are subject to each merchant’s individual policies. In the event of any issue, shortage, or damage related to a delivered order, the user must submit a complaint within a maximum period of 24 hours from the recorded delivery time. Failure to report within this period results in forfeiture of the user’s right to object.

6.2 Official Complaint Channels

Complaints must be submitted exclusively through the platform’s official support channels, including:

  • The in-app customer support and live chat system (In-App Support).
  • The official support email listed in Section 13.

7. User Conduct

7.1 Prohibited Activities

Users are prohibited from:

  • Using the application for illegal purposes.
  • Misusing the platform or manipulating orders.
  • Creating fake accounts.
  • Using stolen payment methods or cards.
  • Harassing or threatening merchants or delivery couriers.

Swift reserves the right to suspend or permanently terminate accounts and confiscate balances as a contractual penalty in cases of violation.


8. Intellectual Property

8.1 Ownership Rights

All application content, including logos, visual identity, designs, text, and software, is the exclusive property of Verlibanand protected under Iraqi and international copyright laws. Such content may not be copied, reproduced, or used without prior written authorization.


9. Limitation of Liability

9.1 Maximum Compensation

Swift is not responsible for the quality or safety of products, nor for any indirect financial or commercial losses incurred by users. In cases where direct negligence by the platform is legally established, the maximum and final compensation payable by Swift shall not exceed the total monetary value of the disputed order only.


10. Account Termination

10.1 Voluntary Deletion & Suspension

Users may request deletion of their accounts at any time through the application settings, provided all outstanding obligations are settled. Swift reserves the right to suspend, restrict, or terminate any account immediately and without prior notice in the event of a violation of these Terms & Conditions.


11. Amendments

11.1 Updates to the Terms

Swift reserves the right to modify these Terms & Conditions at any time based on operational or legal requirements. Users will be notified of updates through the application, and continued use of the platform after such updates constitutes explicit acceptance of the revised Terms.


12. Governing Law

12.1 Jurisdiction

These Terms & Conditions shall be governed and interpreted in accordance with the laws of the Republic of Iraq, including Iraqi civil and commercial laws. Any disputes arising from these Terms shall be subject exclusively to the competent courts of Baghdad, Iraq.
